New York State
Within New York State, the Uniform Fire Prevention and Building Code (Uniform Code) and the Energy Conservation Construction Code are adopted as the building and energy codes and apply to construction projects state-wide.
However, New York state law allows local governments to enact or adopt local laws and ordinances that impose standards for construction that are “higher” or “more restrictive” than the corresponding standards imposed by the Uniform Code and State Energy Code. The Department of State’s Fire Prevention and Building Code Council is empowered to approve these more stringent local construction codes.

The Code Council is empowered to maintain and periodically update the Uniform Fire Prevention and Building Code and State Energy Conservation Construction Code and to adopt higher or more restrictive local standards upon the recommendation of local governments. Codes include:

The Multiple Dwelling Law (MDL) sets forth regulations and standards for buildings in which three or more families live independently. It addresses issues such as safety, sanitation, maintenance, and other aspects of multiple dwelling structures. The law aims to ensure the health, safety, and well-being of residents in multifamily residential buildings.
